Three Million Dollar Settlement in Slip and Fall Prenatal Case

Our clients, a mother and a father in their thirties, filed a suit against a major supermarket chain for a slip and fall incident. The mother, who was pregnant at the time, slipped over spillage on the supermarket floor and fell. Her child sustained prenatal brain damage from the accident and died because of these injuries. We found a highly qualified medical expert who gave the opinion that the prenatal injury was caused by the mother's fall. Because of our thorough investigation of the circumstances and a thorough pre-trial discovery process, we persuaded the supermarket that it had been negligent when its staff did not clean up the spillage in time to prevent the slip and fall. The infant died prior to the conclusion of the case, which we eventually settled for $3,500,000. The amount would have been much higher if the child had lived because of the costs that would have been incurred for the constant treatment and care of the infant.
