Ophthalmologist Patient Wins Settlement in Medical Malpractice Suit

Our client, a crane operator in his thirties, went to an ophthalmologist at a discount warehouse retail chain because he was having vision problems. The ophthalmologist gave him a prescription to treat his problem. The ophthalmologist did not, however, test our client's eyes for pressure, which would have disclosed a threatening glaucoma condition. Months later, another ophthalmologist determined that our client had lost 80% of his field of vision in his right eye. As required by Florida law, we were able to get certification for our client stating that the ophthalmologist's treatment did not measure up to the prevailing community standard of care. Through negotiation, we obtained a $400,000 settlement for our client.
